Terms of use
Please read the following carefully and sign the declaration below.
• The gym is for the use of Rise to Fitness members only, therefore guests are not allowed.
• For reasons of health and safety, members must adhere strictly to the following:
-All free weights are to be returned to their racks after use.
-Cups and mugs are not allowed in the gym.
- Members should bring a small towel to wipe down machinery after use.
Tracksuits or shorts and t-shirts must be worn at all times.
-Suitable footwear should be worn at all times.
-Offensive language or behavior will not be tolerated.
- Clashing weights, excessive noises and mistreatment of equipment is not allowed
Anyone thought to be under the influence of alcohol or drugs will be ejected and their membership will be reviewed.
•Rise to Fitness reserve the right to exclude any member they deem not to be adhering to any of the above or whoby their actions poses a health and safety risk.
Intellectual property rights
1. All content, including logos, designs, and workout programs, are the exclusive intellectual property of the gym.
2. Unauthorized use or reproduction of any materials is strictly prohibited.
3. Users may not copy, distribute, or modify any content without prior written consent from the gym.
4. Trademarks, including the gym’s name and logo, are protected by intellectual property laws.
5. Any violation of intellectual property rights may result in legal action.
6. Users are prohibited from using any third-party content on the gym's website without the proper licenses or permissions.
7. The gym reserves the right to take down any user-generated content that infringes on intellectual property rights.
8. All intellectual property rights are retained even after the termination of membership or services.
Prohibited activities
1. No unauthorized personal training or coaching without approval.
2. No smoking, alcohol, or drugs allowed on gym premises.
3. No dropping or throwing weights recklessly.
4. No use of inappropriate language or offensive behavior.
5. No improper use of equipment; always follow safety guidelines.
6. No entry without valid membership or guest pass.
7. No food or drinks, except water, in workout areas.
8. No improper gym attire; wear appropriate workout clothing and shoes.
9. No personal belongings left on the gym floor; use lockers provided.
10. No photography or recording without consent from those involved.
Termination clause
1. Members may terminate their membership at any time by providing a written notice to the gym at least 30 days in advance.
2. The gym reserves the right to terminate a membership immediately if the member violates any terms of the membership agreement or gym policies.
3. Memberships may be suspended or terminated for non-payment of fees after a 7-day grace period following the payment due date.
4. Members are not entitled to a refund for any unused portion of their membership upon termination, except as required by law.
5. The gym may terminate or suspend membership for inappropriate behavior, including but not limited to harassment, abuse of equipment, or misconduct within the gym premises.
Governing law
1. Health and Safety Regulations: Gyms must comply with local health and safety regulations to ensure the well-being of all members and staff.
2. Licensing and Permits: A gym must obtain the necessary business licenses and permits as required by local and state authorities.
3. Employment Law: Compliance with labor laws, including minimum wage, working conditions, and non-discrimination laws, is required for all employees.
4. Liability Insurance: Gym owners are often required to have liability insurance to protect against potential lawsuits for injuries that occur on the premises.
5. Data Protection and Privacy Laws: Personal information collected from members (e.g., addresses, payment details) must comply with data protection laws such as GDPR or CCPA.
6. Consumer Protection Law: Gyms must adhere to laws regarding fair marketing, transparent membership contracts, and refund policies to protect consumer rights.
7. ADA Compliance: The gym should meet accessibility standards set by the Americans with Disabilities Act (ADA) to accommodate all members.
8. COVID-19 Guidelines (if applicable): Following local health department guidelines for hygiene, social distancing, and capacity restrictions related to COVID-19.
